Court Lets Calif. Reefer Rule Stand

Despite a challenge from the American Trucking Associations (ATA), California’s “reefer retrofit” rule requiring trucks in and out of the state to upgrade its transport refrigeration unit (TRU) with the goal of helping to reduce emissions will stand. ATA petitioned the courts to reconsider the rule, which has been enforced in California since Jan. 1, because the state essentially imposed a national standard for the rest of the nation’s carriers to follow. An ATA spokesman said it is unlikely that the Supreme Court would review it, and as a result, the litigation would not be pursued any further.

A federal court denied an American Trucking Associations petition requesting that the full court reconsider a three-judge panel’s previous decision that let California’s “reefer retrofit” rule stand.

“Upon consideration of [the] petition . . . and the absence of a request by any member of the court for a vote, it is ordered that the petition be denied,” the court said in a posting Thursday.

The California Air Resources Board has been enforcing the phased-in transport refrigeration unit, or TRU, rule, since Jan. 1.
